On Friday, June 1, 1923, Whitaker shot Michel four times at close range in the lobby of the theater. The two had been "having trouble" for several months, with Michel being arrested on an assault charge against Whitaker the week before his murder. Michel, age 33, was having an affair with, or at least flirting with, the wife of 21 year old Henry Whitaker.
